J-1 Visa Program

TRAINEE RESPONSIBILITIES

Please carefully review the Code of Conduct, which you signed before applying for your visa with Pan Atlantic. These principles are in effect throughout your full stay in the United States. You must also review and follow the policies set out by your host company. Failure to adhere to the policies of Pan Atlantic and your host company is grounds for immediate dismissal.

1. You are in the United States on a J-1 visa as a Goodwill Ambassador from your home country. This must be reflected in all of your activities, behaviors, demeanor and dress.

(a). Your officially designated sponsors are Patrick Murphy, Victoria McCammon Murphy and Leika Powers. They are legally obligated to inform the US Department of State of your progress, and any difficulties (legal or ethical) should such arise during your stay in the United States. Pan Atlantic must be notified of any problems you may have with the law or legal authorities while in the United States which may result in revocation of your Visa.

IF YOU ARE ARRESTED WHILE IN THE U.S. YOUR PROGRAM WILL BE TERMINATED, YOUR VISA WILL BE CANCELLED AND YOU MUST LEAVE THE US WITHIN 7 DAYS.

(b). You must take seriously and obey all laws of the United States. In particular please pay attention to all laws governing driving, drinking and controlled substances. Any infraction of the laws governing driving and drinking and/or drug involvement will result in immediate revocation of your J-1 status and immediate deportation. These laws are not to be taken lightly. You must abide by them.

(c). You must also keep Patrick Murphy, Victoria McCammon Murphy and Leika Powers informed of your whereabouts at all times. As your sponsor we are required by the US Department of State to have this information. We must be able to contact you with very short notice. In particular, you may not leave the country without notifying Patrick Murphy, Victoria McCammon Murphy or Leika Powers prior to departure. This includes even a day trip to Mexico or Canada. Failure to comply with this rule can result in a revocation of your Visa.

(d). If for any reason you are unable to participate in your training program for a period beyond 2 weeks, you are considered to have a break in your training and your program will end. This includes, but is not limited to illness, death of a relative or emergency. These are State Department rules.

(e). As your sponsoring organization, we reserve the right to terminate you from the program for improper conduct or poor, or, indeed non-performance of duties. We also reserve the right to cancel your visa at our discretion for serious medical conditions with unknown outcomes that may lead to a break in training (see 1(d)), including, but not limited to, major surgery, pregnancy, or long term illness.

(f). Sexual Harassment is very seriously regarded in the United States, both within a professional setting as well as in your personal and social life. Please be aware of the cultural differences and keep in mind that in the US, inappropriate language, touching, or sexual innuendo can be grounds for immediate dismissal from your host company and revocation of your visa. Please refer to your host company's sexual harassment policy for details of their specific guidelines and requirements.

2. As a representative of your home country, we and your host company, expect you to dress appropriately and act courteously at all times.

3. Punctuality is critical. Americans are very time conscious, and tardiness is seen as a significant and serious fault. Plan to arrive at all appointments and meetings at least ten minutes ahead of schedule.

4. Maintain the trust of your host company at all times while maintaining confidentiality and discreet working habits. Do not misrepresent yourself, your host company, Pan Atlantic, or any agency involved in any way, at any time. Always be forthright and honest about why you are here and what you are doing here. Do not misrepresent your visa status in any way.

5. Remember, this is a private program which will be closely scrutinized at many levels. Your performance and demeanor will have a direct impact on how this program is received and whether or not it is successful. This will also significantly affect whether or not other trainees will be given the same opportunity that you have had. Please bear this in mind at all times.

6. As your sponsoring organization, we will be making periodic supervisory visits throughout the United States, and you should be available for reviews, as requested.

7. You have given both the United States Department of State and your sponsors affidavits guaranteeing your intention to leave the United States on the conclusion of the program and return to work in your home country in the industry of your training. The Department of State/Department of Homeland Security (DHS) will track your exit status by computer, and so it is important to leave the United States when obliged to do so. Your own future re-admissions and the status of future programs depend on it.

8. Pan Atlantic is your designated J-1 visa sponsor, and your designated Alternate Responsible officers are Victoria McCammon Murphy and Leika Powers. 9. In the event of a major dispute with your host company, Pan Atlantic will do everything possible to help resolve the problem. One of our roles as your J-1 visa sponsor is to act as liaison and mediator between you and your host property should serious difficulties arise. You should understand that any such problem which leads to the host company demanding your termination, which cannot be remedied, will result in your return to your home country. Your J-1 status is valid only for traiing with your designated host property. Pan Atlantic has been very successful in helping to resolve problems when informed early!

10. Your J-1 status is valid only for training with your designated host company. If you plan to leave your position DO NOT RESIGN WITHOUT FIRST SPEAKING TO A REPRESENTATIVE FROM PAN ATLANTIC. IF YOU ARE TERMINATED YOU MUST LEAVE THE US WITHIN TWO (2) WEEKS TIME. Please be aware that the 30 day grace period granted to trainees who complete their 18 month program is not applicable to terminated trainees.

11. Finally, you should remember that you are coming to the United States of your own free will to participate in an pportunity for cultural exchange and mutual understanding between our nations.
